JUDGEMENT

(1.) CONTENTION of the learned counsel for the petitioner is that as per the guidelines issued by the State Government dated 27/4/2012 (Ann.4) passed on the recommendations of Justice Wadhwa Committee, preference was required to be given to Mahila Samuha for allotment of the fair price shop. Petitioner Annapurna Mahila Sahkari Samiti Ltd. is a cooperative society consisting of women and is engaged in various small scale works. Petitioner applied for allotment of the fair price shop, yet the District Supply Officer, Sikar (DSO) - respondent No. 4 has not given any preference to the petitioner and has proposed to allot the shop of Jeenmata Sikar in favour of respondent No. 5 - Shiv Pal Singh. Counsel in this connection has referred to clause (iii) of the guidelines of Ann.4 and in particular clause 3ka(1). It was argued that even otherwise, the cooperative society has to be given preference over an individual and if it is cooperative society of women, which has been given still high priority. Having regard to the fact that official respondents have given preference to respondent No. 5 - Shiv Pal Sing, they have to justify as to why preference was not given to the petitioner. In the circumstances, already the District Supply Officer, Sikar has issued order, therefore petitioner is required to approach the Food Commissioner, Department of Food & Civil Supply, Government of Rajasthan, Jaipur, who shall after hearing petitioner and respondent No. 5, pass appropriate order within three months as to the guidelines of the decision of the District Supply Officer, Sikar dated 26/9/2012 (Ann.10). If authorization has not been issued to respondent No. 5 for allotment of the fair price shop, same shall not be issued till such time representation of the petitioner is decided.
(2.) WITH the aforesaid direction, writ petition stands disposed of.;
