JUDGEMENT

(1.) THE petitioner herein seeks issuance of a writ in the nature of habeas corpus with the submissions that he contacted marriage with the alleged detenue Ms. Roop Kanwar on 30.06.2006 and out of wedlock a boy named Shivam was born in the year 2008. THE petitioner has stated the grievance in the manner that though he was living with his wife and son for some time but his father-in-law with other relatives took his wife and son away; and that the petitioner and his family members are not permitted to meet his wife and son who are allegedly in illegal detention of the respondents. It is also alleged that the petitioner has approached the police authorities but they have not taken appropriate steps yet.
(2.) THOUGH no document has been filed in support of the suggestion that the petitioner made any report to the concerned authorities but the petitioner has filed an additional affidavit with the submissions that he had made a written report to the police but he was not given the copy thereof despite demand and no steps were taken by the police authorities. The submissions remain rather vague and uncertain.
It is difficult to find out from the submissions as made that the petitioner did make any report before the concerned police authorities. Then, if such report was made but was not registered or taken care of, the petitioner could have taken recourse to the appropriate remedies in accordance with law. We have even otherwise reservations on entertaining this petition as framed and filed because the petitioner appears not to have taken recourse to the other regular remedies which are available in law including those under Section 97 of the Code of Criminal Procedure.
We can only observe that the petitioner is, of course, free to take recourse to every appropriate remedy which is available in the matter; however, on the submissions as made, we are not inclined to entertain the matter at this stage so as to consider issuing a writ in the nature of habeas corpus.
With the observations foregoing, this petition stands dismissed.;
