(1.) HEARD.
(2.) THE present misc. petition has been preferred by the petitioner seeking quashing of F.I.R. No.165/2011 registered against him at P.S. Lalgarh, District Sri Ganganagar, for the offences under Sections 420, 467, 468, 471, 416 and 198 IPC.
Counsel for the petitioner contends that another FIR with the same allegations was filed in relation to the same land in question in the year 1996 being FIR No.331/1996 and the police after investigation gave F.R. He submits that the present FIR, which is impugned in the instant misc. Petition, is nothing but a second FIR on the same facts. 3. The I.O. Present in Court has placed before this Court the case diary as per which the allegation in the present FIR is that the petitioner by making impersonation has obtained loan from the Bank fraudulently. Obviously, such allegations could not have been made in the year 1996, when the first FIR was lodged. Further, there is a list available on the record, as per which, as many as 18 cases of fraud and cheating have been registered against the petitioner.
Thus, this court is of the opinion that the exercise of inherent powers of this Court under Section 482 Cr.P.C. is not called for in the instant case for quashing the proceedings of the FIR impugned.
Resultantly, the present misc. petition, being bereft of any force, is hereby dismissed.
Stay petition is also dismissed.
