JUDGEMENT

- (1.) THE grievance which has been raised by the petitioner is that despite the petitioner having approached the SHO, Police Station Malakhera, District Alwar for recording the Missing Person Report in respect of her daughter Kumari Sapna @ Kali, the police has not recorded either the Missing Person Report or FIR in this behalf. We are of the view that the habeas corpus is not a remedy for such inactions and proper course would be for the petitioner to approach the learned Magistrate in the facts and circumstances of the case by way of a complaint.
(2.) BE that as it may in the facts and circumstances of the case and in view of the prayer, it is directed that on production of this order, the SHO, police Malakhera shall record the report and proceed with the investigation in accordance with law. With the aforesaid observations, this habeas corpus petition stands disposed of. A copy of this order be also sent to the Superintendent of Police, Alwar for compliance.;
