JUDGEMENT

(1.) HEARD learned counsel for petitioner and the learned Additional Government counsel.
(2.) PERUSED the reply and the documents submitted along with petition as well as the order passed by the Advisory Committee. Though the Advisory Committee has rejected the application for grant of parole on the ground that there is threat of life to the victim and his family in case the petitioner is released on parole. Learned counsel pointed out that during trial, the petitioner was on bail and had that been so, this fact negativates the aforesaid opinion given by the Advisory Committee.
We have considered the the reply and the aforesaid contention and the order passed by the Advisory Committee.
So far as the conduct of the petitioner in jail is concerned, that has been certified to be satisfactory. The petitioner has also earned the remission during the period in which he had remained in jail. In the facts and circumstances of the case and more particularly the fact that the petitioner was on bail during trial, we are inclined to accept this petition and grant the benefit of first parole of 20 days to the petitioner.
Consequently, we allow this writ petition and direct the Superintendent, Central Jail, Ajmer to immediately release the petitioner namely Shankar S/o Shri Shravan on 20 days regular parole on his furnishing personal bond in a sum of Rs.50,000/- (Fifty Thousand only) with two sureties of Rs.25,000/- (Twenty Five Thousand) each, to the satisfaction of the Superintendent, Central, Jail, Ajmer on usual terms and condition and as per rules. The Superintendent, Central Jail, Ajmer shall also fix the date for surrender of the accused petitioner.
The petition accordingly, stands allowed as aforesaid.
