JUDGEMENT

- (1.) THOUGH nobody has appeared for the petitioner but in view of the fact that similar nature petitions have already been decided, there appears no reason to keep this petition pending; and hence, the same is taken up for final disposal in terms of the orders already passed.
(2.) THE petitioner has essentially stated grievance in this writ petition against the process taken up by the respondents for changing the size of outlet wherefrom he has been receiving the irrigation water. The learned counsel for the respondents has pointed out that similar nature writ petitions have been considered and decided by this Court; and has placed for perusal a copy of the order dated 04.10.2007 as passed by this Court in a batch of similar writ petitions led by CWP No.851/2007 and then, the order dated 28.04.2011 as passed in another batch of writ petitions led by CWP No.6735/2005 and yet another order dated 30.05.2001 in another batch of writ petitions led by CWP No.6358/2005. In the order dated 28.04.2011, this Court found and observed as under:- "These petitions, involving identical issues on similar facts have been considered together; and are taken up for disposal by this common order. The petitioners have stated their grievance in these petitions against the process taken up by the respondents for changing the size of the outlet wherefrom they have been receiving the irrigation water. The learned counsel for the parties have pointed out that similar nature writ petitions have been considered and decided by this Court; and have placed for perusal a copy of the order dated 04.10.2007 as passed in a batch of similar writ petitions led by CWP No. 851/2007. It is noticed from the said order dated 04.10.2007 that even while dismissing the similar nature writ petitions, this Court made it clear that the respondents shall not in any manner take any step that may affect or reduce water supply even in micro level below the one originally sanctioned to each of the petitioners. The learned counsel for the parties are ad idem that the directions aforesaid essentially govern the present cases too. In view of the aforesaid and in terms of the said order dated 04.10.2007, these writ petitions are also dismissed but with the same directions as noticed hereinabove. No costs."
(3.) THE directions and observations aforesaid squarely govern the present case too. Hence, this writ petition is also dismissed in terms of the orders aforesaid and with the same directions. No costs.;
