JUDGEMENT

(1.) HEARD learned counsel for the parties. Learned counsel, Ms Neetu Bhansali is appearing for the petitioner pursuant to her appointment made by the Secretary, Rajasthan High Court Legal Aid Committee upon our order dated 18.4.2012.
(2.) PERUSED the reply including the nominal roll. It has been stated in the nominal roll that the conduct of the petitioner in judicial custody has been found to un-satisfactory. Apart from that the petitioner while having been previously released on parole, had absconded and was convicted for offence u/s 224 IPC.
In view of the provisions of Rule 9 of the Rajasthan Prisoners Release on Parole Rules, 1958 dealing with the eligibility condition that the conduct of the prisoner in jail must be certified to be satisfactory. The petitioner cannot be granted the benefit of parole at present. Accordingly, this letter petition stands dismissed.
A copy of this order may be sent to the petitioner in jail through the Superintendent of Central Jail, Bikaner where the petitioner is at present lodged.
However, we find that the petitioner is a resident of Kota and is at present lodged in the Central Jail at Bikaner, we would direct that the respondents would consider his case for transfer to the district jail closer to Kota so as to facilitate the members of the family of the petitioner to visit him.
The petition accordingly stands disposed.
