JUDGEMENT

(1.) THOUGH the matter has been placed for consideration of
the application (IA No.15101/2011) as moved by the plaintiff-
respondent seeking modification of the interim order dated
14.01.2009 but, in this matter where the parties are closely related as aunt and nephew (Bhua Bhatija), the learned
counsel for the parties expressed existence of elements of
settlement and then, the communications were exchanged for
such amicable settlement.
(2.) TODAY , both the parties i.e., the defendant-appellant (nephew) and the plaintiff-respondent (aunt) have appeared
before the Court with their respective counsel and it appeared
that a comprehensive settlement could be arrived at between
the parties so as to take care of all their disputes including the
present one and the other pending cases.
In view of the above, the parties were referred to the
Mediation Centre and Mr. Manish Shishodia, one of the trained
mediators, present in the Court was requested to act as
Mediator.
Mr. Shishodia has now placed before the Court a comprehensively drawn settlement between the parties in
relation to all their cases including the present one. The terms
of settlement as reduced in writing and signed by both the
parties are taken on record and shall be construed as forming
part of this order.
It may be observed that the parties have arrived at
settlement not only in relation to the subject matter of this
appeal but also in relation to the subject matter of all their
other pending cases and in fact, the settlement has been
made so as to bring an end altogether to the misgivings
between the parties; and the parties have shown their
keenness and willingness to restore all their family ties,
relations and goodwill qua each other.
(3.) THE efforts as made by the learned counsel for the parties and so also by the Mediator to bring the parties
together do deserve due appreciation. As the settlement
proposal has been worked out comprehensively to deal with all
the disputes, this Court considers it proper to make the same
a part of this order and to make a comprehensive order so that
all the matters are adequately dealt with.;
