JUDGEMENT

(1.) BY this petition for writ the petitioners are claiming direction for grant of bonus marks pertaining to the questions asked in Teacher Grade-III Direct Recruitment Competitive Examination, 2012 said to be out of the Syllabi prescribed. A direction is further sought to declare the answer key and also to have access to the OMR sheets. The directions aforesaid are sought by alleging several irregularities in the examination concerned. The irregularities pointed out in the petition are quoted below :-
"C. That respondent No.2 did not followed the procedure for conducting the examination like the bundle of question paper should be sealed but it was not sealed, that question paper and OMR Sheet has same numerical number, but the question paper and OMR Sheet has different numerical number, question paper not submitted to the petitioner after examination, like many other irregularities. D. That, so far irregularities committed by the respondent No.2 in conducting examination for the post, that the question paper are different for the different centers in same district which is against the principle of natural justice and fair play, as the respondent should conducted the examination in proper manner, which is not happened and commit injustice to the petitioners. E. That as per the advertisement 20% weight age of RTET Marks will be added to final result of the candidates, but it was not done and same has not been shown in the marks sheet provided by the respondent No.2. F. That, so far near about 20 questions or may be more are not asked to the other examination center of the same District means that respondent No.2 committed irregularity in printing of question papers as the petitioners belong to same stream of subject English but they faced different question paper for the same post at same district, it also means that respondent No.2 committed injustice to the petitioners by issuing different question paper for the same examination more so some of the question also asked by the respondent out of Syllabus as provided by the respondent No.2. A detail of all these questions annexed herewith and marked as Annexure-7. G. That, in the above back ground of the case, petitioner deprived to get public employment because of those actions mentioned above is arbitrary action on the part of respondents, hence liable to be quashed and set aside, being violative of Articles 14, 16 and 21 of the Constitution of India. H. That there is fault on the part of respondents to set up the question papers, whereby they have not cautioned while preparing question papers. It is absolutely arbitrary on the part of respondents because one side they are prescribing syllabus and another side they are asking question out of prescribed syllabus, and not cautioned in printing of papers and their distribution. I. That it is one more arbitrary action on the part of respondents because they have not issued answer keys for the aforesaid examination."

THE Teacher Grade-III Direct Recruitment Competitive Examination, 2012 was conducted on 2.6.2012, but no care was taken by the petitioners to point out any alleged wrong on 2.6.2012 or immediately thereafter. The petitioners at the first instance agitated their cause with the allegations referred above only after declaration of the result of the examination. If the petitioners were having any grievance because of the irregularities taken place then they should have raised all their objections before the competent authority immediately after holding of the examination or at least prior to declaration of the result. At the stage when the entire process of the examination has been completed, I am not inclined to interfere with the process in exercise of the discriminatory powers of this Court. The petition for writ, therefore, is dismissed.;
