JUDGEMENT

(1.) AT the request of parties, final arguments were heard and writ petition is being disposed off.
(2.) THE petitioner has preferred this writ petition challenging orders dated 18th October, 2004, 20th April, 2005 and 17th July, 2007. Vide order dated 20th April, 2005, Central Administrative Tribunal, Jaipur Bench(hereinafter referred to as 'the Tribunal') dismissed Original Application No. 170/2005 filed by the petitioner. Vide order dated 17th July, 2007, the Tribunal dismissed Review Application No. 17/2005 in Original Application No. 170/2005 filed by the petitioner.
Briefly stated the facts of the case are that the petitioner initially filed Original Application No. 360/1992(72/1987), under Section 19 of the Administrative Tribunals Act, 1985, praying therein that the order of respondents dated 23rd January, 1987 be quashed and they be directed to allow him to appear in the selection of T.I. Grade Rs. 455-700 and they also be ordered to count him in the grade Rs. 550-750 since January, 1986 with all consequential benefits. An interim order was passed by the Tribunal in favour of the petitioner on 19th February, 1987 to maintain status quo till further orders. Subsequently, interim order was modified on 31st May, 1988 and it was directed that one post of T.I. be kept vacant to adjust the applicant, if he succeeds. Original application filed by the petitioner was heard finally by the Tribunal. Counsel for the applicant submitted that the applicant is working against the vacant post and has not been reverted. He further submitted that the applicant is retiring on 31st May, 1993. On the basis of statement made at Bar, the Tribunal passed an order that the applicant will continue to hold this post up to 31st May, 1993, if he has not been reverted so far and he will be entitled for pensionary benefits according to the rules. With the aforesaid observations and directions, Original Application No. 360/1992 was disposed off by the Tribunal vide order dated 13th May, 1993.

THE petitioner again filed Original Application No. 602/1993 before the Tribunal with a prayer that respondents be directed to treat the applicant as a substantive appointee on the post of TI from the date he was appointed to the said post and he may be granted benefit of further promotion in the cadre of Traffic Inspector. One of the prayers, amongst others, was that the respondents be directed to grant promotion to the applicant in the cadre of Station Master, as the applicant qualified the suitability and selection test in the aforesaid cadre. The case of the applicant in nutshell was that he be promoted to the higher posts/scales of Traffic Inspector, Station Master and Station Superintendent.;
