JUDGEMENT

- (1.) HEARD learned counsel for the parties and perused the petition as well as reply.
(2.) THIS parole petition has been filed on behalf of petitioner Arun Singh S/o Shri Khushiram for release on first regular parole which has been refused by the Advisory Committee on account of adverse report given by the Superintendent of Police. Notice of the petition was given to the respondents who have filed their reply. As per reply, the conduct of the petitioner has been certified to be satisfactory vide annexure R/1, the nominal roll. The petitioner has also completed the mandatory ? sentence for being eligible for released on parole. The Social Welfare Officer has recommended the case of the petitioner for being released on parole. However, we find that the Superintendent of Police vide report dated 24.1.2012 has given an adverse report against the petitioner. It is not in dispute that the petitioner had earlier been granted emergent parole on account of the death of his brother and has thereafter surrendered before the jail authorities within time. It is not the case that the petitioner had misused the liberty while on permanent parole . Accordingly, this petition is allowed. The Superintendent of Central Jail, Bharatpur is directed to release the petitioner Arun Singh S/o Shri Khushiram on first regular parole for 20 days which shall commence from the date of his release, upon furnishing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only), along with two sureties of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the Superintendent, Central Jail, Bharatpur, on usual terms and conditions, as determined by him. The Superintendent, Central Jail, Bharatpur shall also fix a date for his surrender before the jail authorities. The parole petition stands allowed. ;
