- (1.) LEARNED counsel for the appellant submitted that he has removed the defects today in the registry. Learned counsel for the appellant seeks permission to withdraw the Special Appeal with liberty to file review petition before the learned Single Bench to make observation that civil court will not be influenced by findings recorded by the Tribunal with regard to title over subject plots in question also. Prayer is allowed. Special Appeal is accordingly dismissed as withdrawn with liberty as prayed. D.B. Civil Misc. Application No. 147 of 2012 and D.B. Civil Misc. Stay Application No. 9813 of 2012 also stand disposed of.;
