(2.) The order dated 14.10.2011 passed by the Single Bench in Civil Writ Petition No.10246/05 has been questioned by way of filing the intra-court appeal.

Facts in short are that the respondent Mrs. Jyotsna Kulshrestha was appointed as Lecturer in Shri Veer Balika College way back in the year 1985 which is a government aided educational institution and served there till 1990. Thereafter, she was appointed after regular selection as Lecturer in Shri Khandelwal Vaish Women College under the management committee of appellant institution. She was substantively holding the post of Lecturer. She staked the claim on the post of Principal in the same institution which was advertised in the year 1996. The respondent considering herself to be eligible participated in the selection process and she was ultimately selected and appointed on probation for a period of one year on the post Principal vide order dated 14.11.1996. Subsequently, she was confirmed on the post of Principal vide order dated 22.3.1997 .;
