JUDGEMENT

(1.) A petition under Sec. 10 of the Indian Divorce Act, 1969 seeking dissolution of marriage with his wife Smt. Maye Singh, respondent, had been filed in the Court of learned District Judge, Ajmer, who vide his order dated 13. 5. 1989 passed a decree of divorce subject to the confirmation by this Court.
(2.) WE issued notice to the parties.
Learned counsel for the petitioner informed us that respondent Maye Singh has also filed a complaint for divorce in the Superior Court of District of Columbia, Family Division, Domestic Relations Branch, 500, Indiana Avenue, N. W. Washington, D. C. 200011 being Civil Action No. DR/3714/88a. He also filed an affidavit along with the application and copy of the complaint he received from the Columbia Court. We, therefore, requested the United States Embassy to enquire and inform us about the latest position with regard to that Civil Action. US Embassy, New Delhi informed us that information may be directly collected from Indian Embassy, 2107 Massachusetts Av. , NW, Washington, D. C. 20008. A letter, therefore, was addressed to them. The Embassy has forwarded to this Court the copy of "findings of Fact, Conclusions of Law and Judgment of Absolute Divorce" passed by Superior Court of District Columbia wherein decree for absolute divorce has been awarded in favour of Smt. Maye Singh against the petitioner Arun Michel, on the ground of separation without cohabitation for one year next preceding the commencement of action. The case at Ajmer was instituted as early as 6. 10. 1987, a decree was also passed on 30. 05. 1989 which was sent to this Court for confirmation while the decree has been passed in Columbia Court on 26. 09. 1990.
In view of this matter, we confirm the decree passed by learned District Judge, Ajmer (Family Court ). .;
