JUDGEMENT

(1.) The present application has been filed by the applicant accused seeking his release on bail, after the dismissal of the first application being No.6635/2011 which was dismissed as withdrawn. The applicant was arrested in connection with the written report dated 22.1.2011 lodged by the complainant-Ram Kishore Bairwa at SHO Police Station-Nadoti District-Karauli. The said complaint was registered for the offence under sections 323, 341 and 376 IPC and under section 3 of SC/ST Act as FIR being No.13/2011 at the said Police Station.
(2.) Heard learned counsel Mr. SL Songara for the applicant and learned Public Prosecutor Mr. Laxman Meena for the State.

Having regard to the submissions made by learned counsel for the parties and to the documents on record, it appears that the trial of the case has already started before the concerned sessions court, in which about 14 witnesses including the prosecutrix have been examined. The prosecutrix and other witnesses have supported the case of the prosecution. The allegations made in the FIR are also of very grave and serious nature. However, without entering into the merits of the case, considering the fact that the trial has already commenced and is likely to be over within a short time, and the fact that the allegations against accused are of very serious and grave nature, it is not desirable to release the applicant on bail.;
