JUDGEMENT

Narendra Kumar Jain, J. - (1.) SINCE similar controversy is involved in both the writ petitions, therefore, at the request of learned Counsel for the parties, arguments were heard and writ petitions are being disposed off finally by this common order.
(2.) GRIEVANCES of the Petitioners in these writ petitions are that they appeared in I Year B.D.S. Examination(III Attempt) in August, 2009 in two subjects i.e. 2110 -Human Anatomy and 2130 -Dental Material, but their results have been declared under Old Scheme, whereas it should have been declared under New Scheme. A notice to show cause was given, and in response thereto, the Respondents have filed their reply to writ petition, wherein it is admitted that due to inadvertence, results of the Petitioners have been declared under Old Scheme and they will now declare the Petitioners' results under New Scheme.
(3.) AS agreed by learned Counsel for the parties, writ petitions as well as Third Stay Application No. 5950/2010 filed in S.B. Civil Writ Petition No. 2554/2010 are disposed off as under: (i) The results of the Petitioners for III Attempt of First Year B.D.S. Examination, August, 2009 in two subjects i.e. 2110 -Human Anatomy and 2130 -Dental Material be declared and Mark Sheets be issued to the Petitioners, under New Scheme, after necessary corrections, if any, as per rules, as early as possible, but not later than a period of fifteen days. (ii) The Petitioners were allowed to appear provisionally in Second and Third Year B.D.S. Examination and their results were ordered to be kept in sealed cover. Since, writ petitions relating to III Attempt, First Year B.D.S. Examination have been disposed off, as mentioned above, therefore, Respondents will also declare results of the Petitioners relating to B.D.S. Second and Third Year Examinations within 15 days.;
