JUDGEMENT
Dinesh Maheshwari, J. -
(1.) NOBODY is present for the Petitioner. Nobody was present for the Petitioner on 25.04.2011 also. This writ petition, filed way back on 02.11.2010, has remained pending for admission; and it appears that the Petitioner had lost interest in prosecuting this writ petition.
(2.) EVEN otherwise, there appears no reason to continue with this writ petition any further. In this petition, the Petitioner, stating his grievance against harassment and violation of fundamental rights in the name of investigation in F.I.R. No. 439 dated 21.09.2010, Police Station Pratapnagar, Jodhpur, has prayed for the reliefs in the following terms:
(i) by an appropriate writ, order or direction may be issued to the Respondents not to harassed, detained and to beat the Petitioner.
(ii) the Respondents has not right to call the Petitioner at police station according to their own desire without complying the provision of Section 160 of the Code of Criminal Procedure
(iii) the Respondents may directed to not to torture the Petitioner without rhyme & reason and at the time of interrogation, the relative of the Petitioner may kindly be allowed to present at police station.
(iv) any other appropriate writ, order of direction, which this Hon'ble Court deems just and proper in the facts and circumstances of the case, may kindly be passed in favour of the Petitioner.
(v) Cost of the writ petition may kindly be awarded to the Petitioner.
The averments as taken in the writ petition entail several factual aspects that cannot be determined in the writ jurisdiction. However, looking to the circumstances, it appears appropriate to observe that the Petitioner is free to take recourse to appropriate regular remedy in accordance with law, in case of any grievance subsisting.
(3.) WITH the observation foregoing, the writ petition stands dismissed.
