JUDGEMENT
Narendra Kumar Jain, J. -
(1.) HEARD learned Counsel for the applicant as well as learned Public Prosecutor and perused the material available on record. The applicant is accused of offences under Sections 454 and 380 of IPC.
(2.) LEARNED Public Prosecutor vehemently opposed this bail application. Having considered all the relevant facts and circumstances of the case and looking to the fact that co -accused, namely, Narayan Singh has been released on bail by a Coordinate Bench of this Court vide order dated 11.03.2011 in S.B. Criminal Misc. Bail Application No. 1763/2011, so also, another co -accused person, namely, Manohar @ Ganpat Choudhary has also been released on bail by a Coordinate Bench of this Court vide order dated 27.01.2011 in S.B. Criminal Misc. Bail Application No. 691/2011, without expressing any opinion on the merits of the case, I consider it a fit case to grant bail to the applicant -accused under Section 439 Code of Criminal Procedure
(3.) ACCORDINGLY , this bail application is allowed and it is directed that applicant - Shankar Ram Nayak S/o Nathu Ram shall be released on bail in FIR No. 167/2010, Police Station Dangiawas, District Jodhpur provided he executes a personal bond in the sum of Rs. 40,000/ - along with two sureties of Rs. 20,000/ - each, to the satisfaction of the learned trial court on usual conditions and he shall appear before the trial court on each and every date of hearing and whenever called upon to do so till the completion of the trial.;
