JUDGEMENT

Ajay Rastogi, J. - (1.) COUNSEL submits that Petitioner had participated in the selection process initiated for the post of Teacher Gr. II (Sanskrit Education) and according to Petitioner, the cut off marks for General Female category is 134.03, however, the Petitioner secured 136.11 marks but she has been declared ineligible due to her qualification. Counsel submits that Petitioner fulfills the academic qualification in terms of advertisement and if the Petitioner, despite being eligible and falling in merit, is not considered in the process of counselling, prejudice may cause to her. Counsel submits that in identical CWP -3450/2011 while issuing notices interim order has been passed on 11/03/2011.
(2.) ISSUE notice of writ and stay petition to the Respondents alongwith copy of this order to show cause as to why the writ petition may not be disposed of finally at the stage of admission, returnable within four weeks. Notices may also be given 'dasti', if desired. Two sets of paper book of the petition may additionally be served upon Mr. S.N. Kumamat, who, as informed, is appearing in other connected matters, may seek instructions and inform to this Court, receipt whereof be filed in the registry, on its filing office to show his name in the causelist. PF and notices be filed within seven days failing which stay order shall automatically stand vacated without reference to this Court. In the meanwhile, Respondents are directed to allow Petitioner to participate in the process of counselling to be held for the post of Teacher Gr. II (Sanskrit) in reference to advertisement dt. 20/08/2008, however, it may be on provisional basis and will not confer any right and participation will be subject to final outcome of the writ petition.
