Gopal Krishan Vyas, J. - (1.) In this writ petition, it is submitted by learned counsel for the petitioner that although the controversy involved in this case was adjudicated in Shivlal Pancharia's case in S.B. Civil Writ Petition No. 8301/2008 and the special appeal arising therefrom has also been dismissed by the Division Bench, therefore, compliance order was issued on 16.07.2009, whereby, the Vice Chancellor of the Rajasthan Agriculture University, Bikaner ordered for granting Selection scale of Junior Mechanic on completion of 9 years, Senior Mechanic on completion of 18 years and Foreman on completing service of 27 years to the Drives. But, unfortunately, due to arbitrary action of the Registrar of the University, order was passed on 06.10.2009 by which it is ordered that the benefit is only available to the writ petitioners in S.B. Civil Writ Petition No. 8301/2008, therefore, order dt. 26.10,2009 deserves to be quashed.

After hearing learned counsel for the petitioner, I have carefully scanned the material on record including order dt. 16.07.2009 passed by the Vice Chancellor in compliance of the directions issued by this Court in the writ petition No. 8301/2008 Order dt. 16.07.2009 reads as under : ...[VERNACULAR TEXT OMITTED]...
(3.) In my opinion, after unambiguous decision having been taken by the Vice Chancellor for the compliance of directions issued by this Court in S.B. Civil Writ Petition No. 8301/2008, the aforesaid order .of the Vice Chancellor was to be applied for all drivers in the University. The Registrar of the University while applying arbitrary interpretation has wrongly denied said benefit be the petitioner and passed the following order : ...[VERNACULAR TEXT OMITTED]...;
