JUDGEMENT

- (1.) ISSUE notice. Shri Rajendra Yadav, learned Government Counsel accepts notice.
(2.) THIS habeas corpus petition has been filed by Petitioner -Samay Singh Gurjar with the grievance that her minor daughter has been kidnapped by accused - Rajendra Singh S/o Dhanni Ram, Ramotar S/o Ramulal and Nimkal S/o Devnarayan with regard to which, first information report was also lodged by the Petitioner with Police Station Sikandra, District Dausa for offences Under Sections 363 and 366 IPC on 15/8/2011 but the police has not taken any action to trace -out and recover the girl. Petitioner apprehends that any wrong might have been done to his daughter. Shri Rajendra Yadav, Government Counsel states that he will ensure from the Superintendent of Police concerned to get the matter investigated and make efforts for recovery of the girl.
(3.) IN the light of that statement of the learned Government Counsel, this petition is disposed of with the direction that if however police does not take any action within a fortnight, Petitioner would be at liberty to approach the concerned Magistrate, who shall obviously requisition the report from the concerned investigating officer in connection with FIR No. 256/2011 registered at Police Station Sikandra, District Dausa for offence Under Sections 363 and 366 IPC.;
