JUDGEMENT
Ajay Rastogi, J. -
(1.) COUNSEL inter -alia submits that Petitioners did their final MBBS from the College which is recognized and approved by Medical Council of India and are eligible to appear in the ensuing Pre -PG Entrance Examination -2011 scheduled to be held on 10/02/2011 and they have submitted their admission form with prescribed fee; but may not be permitted to appear on the premise that they have not fulfilled the eligibility condition Clause 2(B) of Instruction Booklet for Pre -PG Entrance Examination -2011 (for admission to MD/MS/Diploma courses) and despite the Petitioners being otherwise eligible if not permitted to appear in the examination -2011 only on the premise that they have not passed their final MBBS from University of Rajasthan/ Rajasthan University of Health Sciences, great prejudice will cause to them.
(2.) ISSUE notice of writ and stay petition, along with a copy of this order, to Respondents, returnable within four weeks as to why petition may not be finally disposed of at admission stage. Notices be given Dasti, if desired. PF and notices be filed within seven days, failing which stay order shall stand automatically vacated. Two sets of paper book of the petition be additionally served upon Shri Virendra Lodha appearing on behalf of Respondent -University -receipt whereof be filed in the Registry. In the meanwhile, Respondents are directed to accept admission forms of Petitioners and shall not reject the same on the premise that they have failed to fulfill eligibility condition No. 2(B) of instruction booklet and further allow Petitioners on provisional basis to appear in written Pre -PG Entrance Examination -2011 scheduled to take place on 10/02/2011 for admission to the post graduate courses (supra), which will not confer any right and shall be subject to final outcome of the writ petition, however, result of their participation be kept in sealed cover and shall not be declared without prior permission of this Court till further orders.
