JUDGEMENT

(1.) These writ petitions have been filed by the petitioners aggrieved by the order dated 24.1.2020 passed by the State
Government inter alia directing for reconstitution of the wards and
to give final shape to the reservation and to draw lottery for the
purpose of reservation for the post of Ward Panch, Sarpanch,
Member Panchayat Samiti, Member Zila Parishad and Pradhan.
(2.) It is inter alia indicated that the initial order dated 9.12.2019 was issued for holding the elections and for the said purpose, vide
Annex.3 the directions were issued for providing reservation.
Subsequent thereto, the State Election Commission issued a
programme on 26.12.2019, whereby, the elections were to be held
in four phases.
(3.) The notifications were issued in the background that initially by order dated 13.12.2019 a Division Bench of this Court while
upholding the reconstitution of various Panchayat Samities till the
notification dated 15/16.11.2019 alongwith corrigendum dated
23.11.2019 were issued, quashed rest of the subsequent notifications.
On 16.12.2019, the Election Commission sought clarification and issued instructions based on the changed circumstances, whereby, based on the Division Bench order, the reservation etc. were to take place.
On 8.1.2020, on a challenge laid to the Division Bench judgment, the Hon'ble Supreme Court stayed the order dated 13.12.2019, based on which, the Election Commission issued an order dated 9.1.2020, whereby, elections to the Gram Panchayats, which were affected by notifications issued subsequent to 15/16.11.2019, were stayed and it was directed that nomination forms etc. produced, be kept in sealed cover. ;
