JUDGEMENT
A.M. Sapre, J. -
(1.) This is a writ appeal under Section 18 of the Rajasthan High Court Ordinance read with Rule 134 of the Rajasthan High Court Rules. It is filed by the appellant, against the order, dated 10.9.2008 passed by the learned Single Judge of this Court whereby the learned Single Judge dismissed the writ petition and upheld the order of the trial court which resulted in rejecting the application made by plaintiff under O. 6 Rule 17 and application made under O. 1 Rule Rule 10 C.P.C.
(2.) Having heard the learned counsel for the appellant and on perusal of the record of the case, we find no case to interfere in such orders in our appellate jurisdiction at this stage.
(3.) In our opinion, the remedy of the appellant is to challenge the order of trial court, if occasion so arises i.e. in appeal against the final judgment and decree that will be rendered in the suit out of which this writ appeal arises. It may be that such occasion may arise or may not. If however, occasion so arises then in such event, the remedy to challenge is always available to the appellant. Since, interim orders do not decide the rights of the parties and hence, no interference is called for in the intermediary period at this stage.;
