JUDGEMENT

- (1.) Heard learned counsel for the petitioner and the learned Public Prosecutor.
(2.) The petitioner, who is Juvenile lodged in Child Reformatory Cell Baran filed this revision petition through his uncle Kajod under Section 53 of the Juvenile Justice (Care and Protection) Act, 2000 against the judgment dated 27.3.2010 passed by Sessions Judge, Baran in Criminal Appeal No. 43/2010 maintaining the order of the Juvenile Justice Board Baran dated 16.3.2010 declining to release him on bail under section 12 of the Act. Brief facts of the case are that an FIR was lodged by complainant Shiv Pal Nayak on 3.3.2010 at PS. Anta Dist. Baran against the petitioner for the offence under Sections 363 and 366 IPC The learned counsel for the petitioner stated that prosecutrix Kaiulash Bai deposed in her statements that she voluntarily left her parental home with the petitioner as she was the finance of the petitioner. It has been pointed out that the accused petitioner Arjun @ Jodhraj being juvenile filed application before the Juvenile Board, but the same was rejected on 16.3.2010. The Juvenile Board has not assigned any cogent reasons for not releasing the juvenile on bail. The uncle of the Juvenile filed appeal before the Sessions Judge, who vide his order dated 27.3.2010 rejected the appeal. Hence this revision petition has been filed. On hearing the arguments of the counsel for the Juvenile and the Public Prosecutor, in my view the juvenile Arjun @ Jodhraj may be released on bail provided his uncle Kajod son of Gopilal shall submit bail bond in the amount of Rs. 25,000/- with two sureties in the amount of Rs. 12,500/- each to the satisfaction of the Principal Magistrate, Juvenile Justice Board, Baran with the stipulation that he will produce the Juvenile before the Court on all dates of hearing and as and when he is called upon to do so. This petition is disposed of accordingly.;
