JUDGEMENT

- (1.) This petition has been filed under Section 482, Cr.P.C. by the petitioners for quashing FIR No.201/2010, P.S. Shastri Nagar, Jodhpur for offence under Section 509, I.P.C. This case came up for hearing on 03.08.2010. On that date, following order was passed by this Court : "This miscellaneous petition has been filed under Section 482, Cr.P.C. for quashing FIR No.201/2010, P.S. Shastri Nagar, Jodhpur on the ground that the FIR has been registered on the basis of complaint of the complainant Mahaveer Singh, A.S.I. posted at Police Chowki, Bhagat-ki-Kothi, P.S. Shastri Nagar, Jodhpur with the allegation that some students related to S.F.I. opened their shirts in front of Registrar of the University Smt. Nirmala Meena and news item was published on 15.07.2010, according to which, the said students committed offence of insulting the modesty of a woman, therefore, it is offence under Section 509, I.P.C. According to learned counsel for the petitioners, the complainant Mahaveer Singh, A.S.I., Police Post Bhagat-ki-Kothi has no jurisdiction to file any complaint on behalf of the Registrar. The only aggrieved person who is the Registrar herself can file the FIR. Therefore, the said FIR may be quashed.
(2.) In this petition, the Investigating Officer was called in the Court with case diary. It emerges from the photographs available on record that the students entered in the office of the Registrar half naked wearing only the pants and they demonstrated their problem in an unseemly manner, that too, before lady Registrar of the University. It emerges from the statement of the
(3.) Registrar Smt. Nirmala Meena recorded in the course of investigation, in which, it is stated by her that she suffered mental agony, so also, she has been insulted by the demonstrators in her chamber.;
