JUDGEMENT
Tashi Rabstan, J. -
(1.)Pursuant to Advertisement Notice No.01 of 2011 issued by respondent No.2, whereby applications were invited for filling up Class-IV posts in the Handicrafts Department, District, Jammu. Petitioner being eligible also applied against the said posts under RBA category. Respondent No.3 interviewed the petitioner along with other eligible candidates. Subsequently in terms of Select List issued on 16.02.2017, whereby petitioner figured at S.No.2 as selected. However, recommendation of the petitioner has been withheld by respondent No.3 on the ground that RBA certificate issued in favour of the petitioner was not valid in the month of February, 2017.
(2.)Being aggrieved, petitioner filed the present writ petition whereby seeking direction to the respondent No.3 to release the recommendation in favour of the petitioner pursuant to select list; with a further direction to the respondents to appoint the petitioner as Class-IV in the Handicrafts Department, District Cadre, Jammu and also seeking direction to the respondents to give effect to the appointment order of the petitioner from the date other candidates had been selected.
(3.)Learned counsel for the petitioner submits that the RBA certificate furnished by the petitioner was valid on the cut-off date. However, appointment in favour of petitioner has been withheld on the ground that the RBA certificate furnished by the petitioner is not valid for the month of February, 2017. It is further submitted that the controversy raised in the instant writ petition is squarely covered by a judgment passed in case titled J & K PSC V. Dr. Shikha Sharma, (LPASW No. 23/2017).
