GH AHMAD BHAT Vs. STATE

JUDGEMENT

(1.) THROUGH the medium of this writ petition, detention of the detenue passed vide order No:DMS/PSA/473/95 dated 15 -11 1995 has been put to challenge by the petitioner.

(2.) PETITIONER has taken almost all the legal, factual and constitutional pleas which are available in such petitions while challenging the detention of the detenue Imtiyaz Ahmad Bhat son of Ghulam Ahmad Bhat R/O Kursoo Rajbagh, Srinagar.

(3.) BESIDES other grounds, the petitioner has pleaded that the grounds of detention are vague and telegraphic in nature and are not understood by the detenue. The grounds of detention are alphabetical and speaks of certain codes which the detenue does not know as the grounds of detention itself shows that the detenue has read upto 9th class/ standard. The grounds of detention start with. "You are a PTM affiliated with banned militant outfit Ikhwan Ul Muslimeen, having its Hqrs. at POK.
