JUDGEMENT

THIS appeal arises from order dated 3rd January, 2003 rendered by the learned Jamnagar District Consumer Disputes Redressal Forum in Complaint Application No. 14/2001 directing the opponent Bank to pay to the complainant interest worked out @ 12% p.a. on Rs. 1,500/ - from 14.11.1995 to 11.9.2000 and to pay an amount of Rs. 2,000/ - by way of compensation for deficiency in service and Rs. 1,000/ - for cost of the complaint.
(2.) THE undisputed facts of the present case are first to be noted. The complainant applied for shares in the opponent Co -operative Bank and paid Rs. 2,500/ - along with application for 100 shares of Rs. 25/ - each. The opponent Bank allotted 40 shares on 7.6.1995 for the sum of Rs. 1,000/ - and issued share certificate to the complainant. The balance amount was required to be refunded by the opponent Bank to the complainant. The dispute starts here.
(3.) ACCORDING to the complainant she opened Saving Bank Account as she was informed that upon opening of the S.B. Account the refund amount of Rs. 1,500/ - would be credited in her account. According to the opponent Bank on account of large number of applications from share holders intimations were issued to the share holders to inform the Bank whether the account was opened so that the refund amount could be credited or whether refund order was to be transmitted by the opponent Bank to the complainant. Complainant's stand was that she did not receive any such communication. Resolving this dispute learned Forum came to the conclusion that there was deficiency in service on the part of the opponent Bank in not crediting the amount of Rs. 1,500/ - into the Saving Bank Account of the complainant which was opened for that very purpose. That resulted into passing of the impugned order.
