- (1.) The erstwhile directors of Blue Horizon IT Solutions Pvt. Ltd.have filed the present appeal under Section 252(3) of the Companies Act, 2013 seeking restoration of the name of the petitioner company which has been struck off by the Registrar of Companies, NCT of Delhi and Haryana.
(2.) Blue Horizon IT Solutions Pvt. Ltd. bearing CIN NO. U72900DL2006PTC155378 was incorporated on 10.11.2006 having its registered office, 2802, Top Floor, Guru Nanak Auto Building Bara Bazar, Kashmere Gate, Delhi-110006, within the jurisdiction of this Tribunal.

It is the case of petitioner that the name of the Appellant Company was struck off from the Registrar of Companies under Section 248 of the Companies Act, 2013, by a suo moto action of the Respondent, after issuing the notification under Section 248(5) in the Official Gazette dated 08.07.2017. The aforesaid action was taken on account of failure of the Petitioner Company to file its statutory returns and other documents since financial year ended on 31.03.2013, giving rise to the reasonable belief that the company was not operational.;
