JUDGEMENT
S.S. Sodhi, J. -
(1.) The controversy here arises from a suit for redemption of mortgage and is with regard to possession of the mortgaged property which consists of a house and two shops.
(2.) The property in suit originally belonged to Chander Shekhar, the predecessor-in-interest of the plaintiffs. On 12th February, 944 he mortgaged it with possession to one Atma Ram for Rs. 14,000/-. On 23rd October, 1951, the mortgagee Atma Ram inducted the mortgagor Chander Shekhar as a ten an in one of the shops while the subsequent mortgagee Ram Lal inducted Chanier Shekhar as tenant in the other property. In this manner, Charder Shekhar came into possession of the entire property as a tenant and executed two rent notes exhibit D/1 and D/2 in favour of Atma Ram and Ram Lal, respectively.
(3.) Later, on 24th November, 1952, as per exhibit D/4, an entry in the deed-writer's register, defendant Puran Chand executed a rent note in favour of Chander Shekhar with regard to one shop. The other defendant-Sohan Lal executed a similar rent note exhibit D/3 in favour of Chander Shekhar regarding the other shop on 21st August, 1953.;
