JUDGEMENT
Jatinder Vir Gupta, J. -
(1.) THIS petition is directed against the order of the Additional District Judge, Jalabdhar, dated 28 -4 -1986, whereby the order of the authority under the Payment of Wages Act, dated 6 -2 -1986 was maintained.
(2.) THE workman Rattan Singh has been working as a Conductor in the Punjab Roadways. His wages were being deducted by the General Manager in pursuance of certain orders stopping his annual increments. The workman alleged that the said orders were non -speaking and were thus illegal and null and void. His wages were being deducted illegally. In reply, it was pleaded on behalf of the General Manager that the application was barred by time and that the orders passed by the General Manager were valid and proper. The authority under this payment of Wages Act found that the orders dated 1 -3 -1982, 5 -10 -1982 and 2 -5 -1983 are non -speaking and, therefore, the deductions made thereunder were unauthorised. Consequently, it was held that the workman was entitled to the restoration of wages only for the period of twelve months preceding the date of presentation of his petition. The said order was maintained in appeal by the learned Additional District Judge. Learned Counsel for the Petitioner relied upon a judgment in Civil Revision No. 2021 of (The General Manager, Punjab Roadways, Jallandhar -I v. Dakha Singh) C.R. 2021 of 1985, decided on 13 -2 -1986, and contended that the authority under the payment of Wages Act could not go into the orders passed by the disciplinary authorities.
(3.) AFTER hearing the learned Counsel for the Petitioner I do not find any merit in this petition, in view of the judgment of this Court in The General Manager, Punjab Roadways, Jalandhar v. Balbir Singh, (1988 -1) P.L.R. 110. The judgment relied upon by the learned Counsel has no applicability to the facts of the present case. Consequently, this petition fails and is dismissed with no order as to costs.;
