(1.) On 14-9-1971 at about 5-45 P.M. Sh. Bhagwant Rai, Food Inspector accompanied by Dr. Ravinder Singh Batra, visited the shop of Daulat Ram accused at Khanna. The Food Inspector after disclosing his identity purchased sample of sweet balls. The accused-petitioner was having about ten kgs. of sweet balls for sale. The Food Inspector purchased 1500 grams of sweet balls on payment of Rs. 3-60 ps. Sweet balls were then divided into three parts and put in three clean plastic bags which were wrapped, labelled and tied with a strong thread and then properly sealed. One sealed bag was given to the accused-petitioner and the second one was sent to the Public Analyst. The Public Analyst reported that the sample was coloured with basic non-permitted red coal tar dye. On receipt of the report from the Public Analyst, the Food Inspector filed the complaint.
(2.) At the trial, Sh. Bhagwant Rai, Food Inspector made his own statement. Dr. Ravinder Singh Batra was given up as unnecessary.
(3.) The accused petitioner denied the allegations made against him.;
