JUDGEMENT

Gurnam Singh, J. - (1.) Ram Chander petitioner was tried for the offence punishable under section 16(l)(a)(i) of the Prevention of Food Adulteration Act. The Chief Judicial Magistrate, Gurgaon, convicted Ram Chander accused for the said offence and sentenced him to undergo rigorous imprisonment for six months and to pay a fine of Rs. 1000.00 and in default of payment of fine to further undergo rigorous imprisonment for six months. The appeal filed by Ram Chander, which was heard by the learned Additional Sessions Judge, Gurgaon, was dismissed. He has filed this revision petition.
(2.) The facts of the case, briefly stated, are that on 8-1-1975 at about 9.15 A.M., the accused was found in possession of a drum of milk for sale by Shri Madan Lal Kapur, Government Food Inspector, Gurgaon. The Food Inspector purchased 660 M.Ls. of milk from the accused and divided it into three parts and then put in three different clean and dry bottles and sealed after adding the preservative. One of the sample bottle was sent to the Public Analyst for test and it was found to be deficient by 95% in milk fat. The Government Food Inspector filed the complaint against the accused.
(3.) Madan Lal Kapur made his own statement and examined Dr. S.B. Madan in addition to the affidavit filed by Kishan Lal.;
