A writ in the nature of certiorari for quashing the order dated 23.07.2008 (Annexure P-16) passed by the Commissioner and Director General (School Education), Haryana, Chandigarh, rejecting the claim of the petitioner for appointment to the post of Head Mistress despite her selection made by the Haryana Staff Selection Commission, has been prayed for in the present writ petition.
(2.) It is the contention of the petitioner that advertisement No.9 of 2006 was issued by the respondents for filling up the vacancies of Head Mistress. The petitioner applied for the said post and was selected. Despite her selection to the post of Head Mistress, the petitioner has not been issued the appointment letter. The petitioner, therefore, submitted a representation to the respondents that despite her selection and her name figuring at Sr.No.33 of the select list, which was prepared in accordance with the merits, she has not been issued the appointment letter. In response to the representation date 23.05.2008 submitted by the petitioner, the Commissioner and Director General School Education, Haryana, informed the petitioner vide communication dated 23.07.2008 that the petitioner do not fulfil the condition of eight years teaching experience as required under the Haryana State Education (School and Inspection Cadres) (Group-B) Services Rules, 1988. It is this communication dated 23.07.2008 (Annexure P-16), which has been challenged by the petitioner in the present writ petition.
(3.) We have heard the counsel for the petitioner and have gone through the records of the case. The qualification, as advertised for the post of Head Master/Head Mistress, are as follows :- "B.A./B.Sc./B.Com or equivalent qualification recognized by Haryana Education Department. Preference will be given to M.A./M.Sc./M.Com. or equivalent Postgraduate qualifications recognized by the Department. B.T./B.Ed./SSTC/SAV/LT/Diploma in basic education or one year teaching training for graduate at University of Postgraduate training college. Eight years teaching experience as Master in Govt. recognized Senior Secondary/High/Middle Schools/Teachers Training Institution, relaxable for four years for the Emergency Commissioned Officer but the total teaching experience and service in the Army should be eight years.";
