JUDGEMENT
S.S. Sodhi, J. -
(1.) The appeal here arises from the wife's petition for annulment of marriage under Sec. 12 of the Hindu Marriage Act, 1955, on the ground of fraud.
(2.) The marriage between the parties took place on March 9, 1981. It was for only a few days that they lived together thereafter. This period, according to the wife being of only four days, while as per the husband's version, they lived together for about 8 to 9 days.
(3.) It was the case of the wife Surinder Kaur that she was minor at the time of her marriage, her date of birth being April 13, 1963. Her marriage, she alleged, had been procured by fraud played upon her by her husband in connivance with her mother, who had been brought under his influence by his representation that he would have her brother sent abroad. Her mother being a greedy lady and with the intention of getting money from her husband who got her married without her consent. It was further stated that her husband was illiterate and was more than 45 years of age. As to the marriage itself, it was said that only 2 or 3 persons had come while her other relations had not even been invited.;
