JUDGEMENT

B.S.YADAV, J. - (1.) THIS order will dispose of the above titled revision petition and revision petition No. 3202 of 1983 bearing the same title which at the time of admission was ordered to be heard along with this petition.
(2.) THE facts leading to this revision petition are that the present respondents had filed an application under section 13 of the East Punjab Urban Rent Restriction Act, 1949 (for short the Act) for ejectment of the present petitioner from premises bearing No. 50 situated in the Industrial Area, Chandigarh. The petitioner is a tenant in the premises in dispute since the year of 1971 on a monthly rental of Rs. 650, in addition to water and electricity charges. The rent was payable on the 1st of each month. Many grounds for ejectment were pleaded in the application but the one that now survives is about non-payment of rent. In the application it was pleaded that since 1st March, 1971 the respondent had paid on different occasions only Rs. 34, 200. The total amount of rent upto March, 1978 comes to Rs. 55,255. Thus the tenant was in arrears of rent amounting to Rs. 21,050. The respondent contested the petition and pleaded that in addition to the amounts of rent admitted by the petitioner, he had also paid rent to Mohinder Singh Johal, who had been authorised to receive rent by applicant No. 1 Dilbagh Singh and no rent was due from him.
(3.) ON the first date of hearing the petitioner did not tender any arrears of rent. After conclusion of the trial, the learned Rent Controller, Chandigarh, held that the petitioner was in arrears of rent and accordingly ordered his ejectment from the premises in dispute. Feeling aggrieved the petitioner preferred an appeal before the Appellate Authority, Chandigarh, met with no success. He has now filed this revision petition in this Court.;
