JUDGEMENT
AUGUSTINE GEORGE MASIH, J. -
(1.) It is the contention of the learned counsel for the petitioners that the petitioners have submitted a
representation dated 30.03.2016 (Annexure P -5) filed under Section 5B(2) of the Punjab Village
Common Lands (Regulation), Act, 1961, but no action thereon has been taken. He further contends
that in the similar circumstances, this Court in CWP No. 26815 of 2015 titled as "Om Parkash and
another Vs. State of Haryana and others", decided on 22.12.2015 (Annexure P -9) had directed the
Principal Secretary to the Government of Haryana as well as the Deputy Commissioner of the
concerned district to consider and take an appropriate decision on such a petition having been
filed by passing a speaking order in accordance with law preferably within a period of four months
from the date of receipt of a certified copy of the order. He also contends that at this stage, the
petitioners would be satisfied in case the similar directions are issued to the authority concerned.
(2.) Notice of motion to respondents No. 1 to 4 only. On the asking of the Court, Ms.Tanisha Peshawaria,
DAG, Haryana, who is present in Court, accepts notice on behalf of these respondents.
(3.) Counsel for the petitioners undertakes to supply three copies of the writ petition to the counsel for
the State under proper receipt during the course of the day.;
