JUDGEMENT

(1.) The petitioner is a practising advocate in this Court and the Supreme Court for the last more than thirty-two years. He has been raising public issues from time to time.
The grievance of the petitioner in the present public interest litigation is that Hon'ble Mr. Justice Jora Singh, a retired Judge of this Court, was appointed as one man Commission of Inquiry by the State of Punjab to enquire into the cases of desecration of Guru Granth Sahib last year. According to the petitioner, disrespect was shown to the learned Judge in the corridors of the Punjab Civil Secretariat at Chandigarh when he went to submit the report. There was no one to receive the report at the allotted time and the offices were closed. A reference has been made to the newspaper report (Annexure P1) published in the Hindustan Times.
(2.) In the aforementioned circumstances, it is submitted that a policy needs to be framed by the State Government so that there is no insensitiveness to the reports submitted by the former Judges of this Court to the State Government; besides, due decorum and protocol is maintained. We have given our thoughtful consideration to the contention of the petitioner and during the course of hearing, it is suggested that this matter would more appropriately be considered on the administrative side rather than in a public interest litigation as the veracity of the news report cannot be taken to be per se truthful without any enquiry and verifying the facts.
The petitioner, who is appearing in person, submits that in case the matter is taken up on the administrative side, he may be allowed to withdraw the petition for the present.
(3.) Accordingly, the writ petition is dismissed as withdrawn.;
