JUDGEMENT
Kuldip Singh, J. -
(1.) It comes out that the petitioner was working as a Sub Divisional Engineer in the respondent-department. He retired from service on 31.10.2013. It also comes out that a chargesheet dated 4.4.2014 was served upon him under Rule 2.2 (b) of the Punjab Civil Services Rules, Volume-II. Thereafter, in the inquiry report dated 24.11.2014, he was held guilty and a show cause notice dated 24.6.2015 was issued.
(2.) Today, the respondents have placed on file the copy of the final order dated 23.6.2016, , which is taken on record, showing that on the basis of judgment of the Civil Court, the inquiry has been dropped, meaning thereby that the petitioner has been exonerated.
(3.) The learned counsel for the petitioner does not dispute the fact that the payments have been released. However, it is claimed that these were released with delay. Since the petitioner was not at fault, therefore, the petitioner is entitled to interest at the rate of 9% per annum on the delayed payment.;
