JUDGEMENT
RAMESHWAR SINGH MALIK,J. -
(1.) Feeling aggrieved against the alleged inaction on the part of respondent authorities, petitioner has approached
this Court, by way of present writ petition under Article 226/227 of the
Constitution of India, seeking a writ in the nature of mandamus.
(2.) Notice of motion was issued and in compliance thereof, reply by way of affidavit dated 10.04.2015 of Deputy Commissioner, Amritsar, was filed on
behalf of respondents.
(3.) Learned counsel for the petitioner places strong reliance on the communication dated 02.01.2007 (Annexure P-2) written by the Senior
Superintendent of Police, Majitha to Sub Divisional Magistrate, Ajnala,
to contend that late Sardar Santokh Singh-husband of the petitioner,
suffered injuries at the hands of the terrorists in an incident, which
took place during the night of 05.03.1988. FIR No.33 dated 06.03.1988
under Sections 307, 395, 511 IPC and 25/54/59 of Arms Act read with
Section 3/4 of T.D. Act, was registered at Police Station Lopoke. It was
further specifically observed by the Senior Superintendent of Police that
Sardar Santokh Singh succumbed to the injuries caused to him by the
terrorists, however, on 06.03.1990. Late Sardar Santokh Singh, during his
lifetime, was given bravery award of L 10,000/- on 16.06.1988, by Deputy
Commissioner, Amritsar. Finally, Senior Superintendent of Police
recommended the case, for financial help to the petitioner.;
