JUDGEMENT

(1.) VIDE order under challenge, Rent Controller, in a pending rent application for ejectment of the petitioner, has assessed rent for the last 78 months. This order has been challenged primarily on the ground that the civil suit, filed by the petitioner, inter se the parties, is pending, wherein he has claimed share in the property in dispute. Even if it is presumed that in his suit, the petitioner will succeed, he shall be entitled to get only 1/3rd share in the property in dispute. At the time of arguments, offer was given to the petitioner to deposit 2/3rd of the amount assessed by the Rent Controller. The said offer was not accepted by the petitioner. This Court is of the view that idea of the petitioner is to grab property of the family, in one way or the other. In the application for ejectment, it has specifically been mentioned that the petitioner is a tenant. Under these circumstances, mere denial on his behalf is of no conseuqence in view of the facts and circumstances of the case. The ratio of judgment in Yashpal Singla vs. Vijay Kumar, 2004(2) Civil Court Cases 603, in view of the facts of this case, is of no help to the petitioner. Dismissed.;
