JUDGEMENT

(2.) ON a request made by the learned counsel for the petitioners, the present petition is treated to be a petition filed under Article 227 of the Constitution of India. At the out set, both the learned counsel for the parties jointly made a request that the order passed by the executing Court may be set aside and the executing court may be directed to get a fresh demarcation report conducted in accordance with law, to determine as to whether any portion of khasra No.977 is in possession of the Food Corporation of India. In view of the aforesaid agreement between the learned counsel for the parties, order dated November 22,1999 passed by the learned executing Court is set aside and the executing court is directed to get the fresh demarcation report by appointing a fresh Local Commissioner in accordance with law. The Local Commissioner shall be directed by the executing court to demarcate the property in question in accordance with the standing orders of the Financial Commissioner and the rules and orders of this court. The final decision shall be taken by the executing Court within a period of six months from the date of appearance of the parties. Civil Revision No.880 of 2000 2 The parties are directed through their counsel to appear before the learned executing court on April 17,2006.;
