JUDGEMENT

(2.) C.M. is allowed. Affidavit attached therewith is taken on record, subject to all just exceptions. The petitioner was retired from service with the respondents rightly on attaining the age of superannuation on 31.8.2002. The age of superannuation of a Mali that is the post against which the petitioner was engaged is 60 years. It is the contention of learned counsel for the petitioner that the petitioner has not yet attained the age of 60 years on account of the fact that his date of birth is 18.8.1952 and, as such, she could not have been retired on 31.8.2002.
Proceedings in this case were adjourned sine die on 4.3.2003, with liberty to the petitioner to place on the record of this case some authenticated documents on the basis of which the age of the petitioner could be determined. Through C.M.No.8653 of 2006, the petitioner has placed on the record of this case, an affidavit of one Onkar Singh son of Amrik Singh allegedly C.W.P.No.3536 of 2003 (O&M) [2] the brother of the petitioner, wherein it is asserted that the petitioner was born on 18.8.1952. We are afraid that the material placed on the record is not sufficient to arrive at a firm conclusion on the issue of date of birth of the petitioner. For the reasons recorded above, it is not possible for us to find out any infirmity in the order of petitioner's retirement w.e.f. 31.8.2002. Dismissed.;
