THE petitioner filed CWP No.865 of 2003 which was disposed of on 4.3.2004 with a direction to the respondents to inquire into the matter within one month in respect of the claim for regularization of services of the petitioner's husband and grant consequential benefits to her. Alleging non-compliance of the aforesaid order, this contempt petition has been filed. On August 31, 2006, Learned State Counsel was asked to seek instructions in the matter.
Pursuant thereto, an affidavit of Chambel Singh, Executive Engineer, Haryana PWD B&R Branch Horticulture, Sector 33, Chandigarh has been filed and as per the averments made in the said affidavit, a post of Beldar has been created by the Finance Department vide order dated 25.10.2006 (Annexure R-II) and services of the deceased husband of the petitioner have been retrospectively regularized against the said post vide order dated 26.10.2006 (Annexure R-1). It has also been averred that the arrears of salary have been paid to the petitioner and case for grant of family pension has been prepared and sent to the Accountant General (A&E), Haryana vide memo dated 27.10.2006. Similarly, ex-gratia employment case has also been sent to the competent authority for approval. In view of the fact that effective steps have been taken to implement the directions issued by this court, I do not deem it appropriate to continue with this petition which is accordingly disposed of with a direction to the respondents as well as the Accountant General (A&E), Haryana to finalize and release family pension to the petitioner forthwith and not later than one month from today. Similarly, approval for the ex-gratia employment shall also be accorded within two months and necessary orders shall follow within two weeks thereafter. Disposed of.;
