JUDGEMENT
MEHTAB S.GILL, J. -
(1.) Learned counsel for the petitioner states that complaint
(Annexure P3) is a false complaint. As per para No.3 of the complaint, it
has been stated that the husband of the complainant was beaten up by the
petitioner. In para No.5 of the complaint, it has been stated that nature of
injuries was minor i.e. simple scratches. Therefore, no medical examination
was got conducted by the complainant i.e. respondent and her husband.
(2.) Learned counsel for the respondent has argued that if the public
had not intervened, husband of the respondent would have been kidnapped.
I have heard the learned counsel for the parties and perused the
petition with their assistance.
(3.) It has been stated in the complaint that accused person i.e.
Parshotam Dass, the father of respondent Nishtha Sharma beat her husband
up near the Maruti factory in Gurgaon. Simple injuries of scratches were
caused to the husband of the respondent. It is strange that though
respondent was given a beating as mentioned in the complaint, there are no
other injuries apart from simple scratches. This has not been corroborated
by any medical report. The kidnapping aspect also seems to be false, as it
has been alleged in the complaint that the husband of the complainant was
going to be kidnapped from a busy area near the Maruti factory in Gurgaon.
Least the husband of the respondent would have done was to go to the
police station and register an FIR against the petitioner. But this also she or
her husband did not do so. It seems the respondent filed the complaint only
to put her father Parshotam Dass petitioner in an awkward situation so that
he did not pursue the aspect of her marriage, with a person which he
(Parshotam Dass) did not to like.;
