JUDGEMENT

(1.) We have heard learned counsel for the petitioner.
(2.) Learned counsel contends that the petitioner is entitled to receive the documents which the department is relying upon and any other relevant document which may be necessary for the petitioner to prepare his defence. He may not be entitled to original of the documents, however, he certainly has the legal right of inspection of the record and to take photocopies or other attested copies of the relevant documents. As the enquiry is pending, it would not be appropriate for this Court to entertain the writ petition. Although Mr. Walia has vehemently argued that the allegation which was the basis of the misconduct having been dropped, there would be no justification to permit continuation of the enquiry. In our opinion, it would not be appropriate for this Court to reach such a conclusion at this premature stage. The petitioner shall be at liberty to agitate the matters which have been agitated in the present petition before the Inquiry Officer as well as the other higher authorities. The petitioner shall also be at liberty to canvass all the points which have been taken in this writ petition, in any subsequent writ petition that may be filed, in case the department proceedings culminate into adverse decision, against the petitioner.;
