(2.) THIS order shall dispose of CWP Nos.7123 and 14153 of 2004 as common questions of law and fact are involved therein. The facts have, however, been taken from CWP No.14153 of 2004. The petitioner has filed this writ petition for quashing of the letters (Annexures P-4 and P-8) and to grant him the disability element of pension on the basis of 50% disability. In addition, the petitioner has also sought a direction for the grant of disability element of pension for the interim period from 15.5.1995 to 30.4.2001 on the basis of 20% disability which was declared to be of permanent nature. So far as the relief of disability element of pension for the interim period, referred to above, is concerned, the respondents themselves have granted the same vide order dated 2.9.2005, a copy of which has been appended as Annexure R-1 with the short reply.
Learned counsel for the parties are also in agreement that the other relief sought by the petitioner in this petition, is squarely answered in his favour by a Division Bench judgment of this Court dated 17.8.2006 passed in CWP No.9979 of 2005 (Naib Subedar Ravinder Kumar v Union of India & Ors.), a copy of which has been appended as Annexure P-1.Accordingly, and in view of the stand taken by learned counsel for the respondents, these writ petitions are allowed in terms of the judgment dated 17.8.2006 passed in CWP No.9979 of 2005 (Naib Subedar Ravinder Kumar v Union of India & Ors., referred to above.
