JUDGEMENT

(1.) The petition has arisen out of the most unfortunate circumstances where the services of a highly qualified lady have been terminated by the Guru Nanak University.
(2.) The brief facts are that the petitioner is a 1st rate athlete of All India fame. She represented Punjab State and Punjab University in Ail India Nationals and Inter-University Meets several times and was the Captain of Punjab State Athletics Team and Punjab University Athletics Team during 1962-63 session. She was also an outstanding player of Volley-ball and remained Captain of Punjab University Women Volley-ball team. She was a member of Indian National Volley-ball team which participated in pre-Asia Zone Volley-ball Championship in 1963. She passed her diploma in physical education from Punjab University and got first class first and was awarded Punjab State Silver Jubilee Scholarship. It is averred in the petition that she is the first lady who obtained coaching certificate in Athletics from National Institute of Sports, Patiala, with 68 per cent marks. The petitioner passed her M.A. from Punjab University and was awarded Scholarship by the Punjab State Language Department, Patiala. The Ministry of Education, Government of India, selected her for U.S.S.R. Scholarship and spent more than Rs. 50,000.00 on her studies abroad. She completed her Doctorate of Philosophy in P. and Physical Education from the Central Institute of Physical Culture and Sports, Moscow. It is also averred in the petition that she is the only woman in India who secured Ph. D. in the field of physical education in sixties. In view of her outstanding sports career Government of India had sent the petitioner a.s an Observer to European Athletic Championship held in 1966 in Hungry, World Volley-ball Championship held in 1966 in Czhechoslovakia and World University games in the World Universiade held in 1967 in Japan. She also introduced herself with the system of physical education prevailing in Universities and Colleges of various countries by visiting United Kingdom, France, Belgium, Holland, Nether-land, German Democratic Republic, West Germany, Polland, Romania, Austria and Afghanistan.

On return from abroad, the petitioner was honoured as an expert and specialist in the field of physical education and was appointed as Lady Lecturer in Physical education in Lakhshamibai College of Physical Education (established by Union Ministry of Education) in the pay scale of Rs. 400-30-640-E.B, 40-800 with two advance increments, i.e., at Rs. 460.00 per mensem on May 12, 1969. Before proceeding for higher studies in U.S.S.R., she had worked as Directress of Physical Education in Shri Guru Teg Bahadur Khalsa College of Delhi in the pay scale of Rs. 400-800 from June 1964 to Dec. 1964. Later on, she was appointed as Assistant Directress of Physical Education in the University of Delhi in pay scale of Rs. 400-40-800-50-950 with five advance increments at Rs. 600.00 per mensem. She joined Delhi University on Sept. 25, 3971 and continued there till July 21, 1972, when she resigned. In the meantime she was selected as Secretary Sports (Women) in the Guru Nanak University, Amritsar, where she joined on July 22, 1972, in the scale of Rs. 400-40-800-50--950 at basic salary of Rs. 600.00 per mensem. Initially she was reluctant, but on the persuation of Shu M.S. Sandhu, respondent No. 36 (her husband), who was the Head of the Sports Department, she joined the Guru Nanak University. It is averred in the petition that she worked to the entire satisfaction of respondent No. 2 and respondent No. 36. During her tenure, this university had, for the first time, won the All-India Women Inter-University Shooting Championship, won the North Zone Women Inter-University Badminton Championship and for the first time University student Miss Kailash Kaur secured second position in Javelin throw in All India Inter-University Athletics Championship. The facts were acknowledged by the Vice-Chancellor in his annual report for 1972-73 that he placed before the Senate.;
