JUDGEMENT

(1.) This petition is directed against the order (Annexure P-1) dated January 1, 1993 issued by the Managing Director of the Punjab State Leather Development Corporation Limited (for short the 'Corporation'). The petitioner has prayed that this order should be quashed and he should be ordered to be reinstated in service with all consequential benefits. Another prayer made by the petitioner is that he should be given an option for 'Golden Hand-Shake Policy' as given to other employees of the Corporation.

The case set up by the petitioner is that he was having good academic record as he had passed M.A. in Sociology, Post-Graduation Diploma in Business Management and Industrial Administration and had also secured diploma in U.N.O. and International Understanding from the Institute of U.N. Studies Delhi. He served in managerial capacities in different Organisations for a period of 10 years before joining the service of the respondent-Corporation as Manager (Personal and Administration) in pursuance of the selection by a duly constituted Selection Committee which was followed by order dated 22nd December, 1984 (Annexure P-2). In recognition of his excellent performance as Manager (Personnel and Administration), the Board of Directors of the respondent-Corporation in its meeting held on January 29, 1987, decided to designate the petitioner as General Manager (Personnel and Administration) in its existing pay-scale with the further stipulation that the case of the petitioner for grant of pay-scale of Rs. 1700-2300 would be considered by the Board of Directors after completion of his three years service with the Corporation. He was confirmed as Manager (Personal and Administration) by an order dated Feb. 8, 1988 (Annexure P-4) issued by the Managing Director of the Corporation. By another order of the same date (Annexure P-5) the petitioner was placed in the pay-scale of Rs. 1700-2300 w.e.f. 4.2.1988.

The petitioner's assertion is that while holding the post of General Manager (Personnel and Administration) he discharged his duties with utmost efficiency and devotion to the duty and his work was appreciated by the Managing Director of the respondent-Corporation vide order dated June 18, 1991 (Annexure P-6). However, on December 3, 1992, the Managing Director of the Corporation issued an order transferring the petitioner from the post of General Manager (Personnel and Administration) to the post of General Manager (Leather Centres) and the duties of the petitioner were ordered to be performed by Shri N.K.Malhotra, Manager Administration. After about a month, the impugned order dated January 1.1.1993 (Annexure P-1) was issued by the Managing Director terminating his services on the pretext or abolition of the post of General Manager (Personal and Administration).;
